| What can I do if I am involved with a Donation Tax Shelter?
The law relating to donation tax shelters is still somewhat uncertain and while it is possible that the full donation claims could be upheld in Court, the current judicial opinion seems to suggest this is unlikely as cases that have gone through the Courts have not been in the taxpayers favour (See Marechaux). As all programs are different, the final outcome of each case unfortunately cannot be predicted. At least one of these cases is scheduled to be heard in Tax Court in the summer of 2012 (GLGI) and hopefully after this decision, it will be clearer whether these donations are valid. You can look for updates on our Donations Project and here are a few key things you can do to help protect yourself from the potential consequences of tax shelter related donations.
